Exception dispositives and new rationalities within punitive system: the appearance of PCC e the RDD model

Abstract

The article proposes one study over changes in the penal practices camp and in the Brazilian punitive system from the democratization process. It tries to elucidate the enigma of a society that passed through a period of human rights growth, but now sees the increasing of arbitrary actions and violence in the realm of prisons. Still, the article discusses how the appearance of the criminal organization called PCC is related to the context of disciplinary and exception practices in the prison system. It shows how the administration of Nagashi Furukawa (1996-2006) improved the prison apparatus with the creation of RDD. As a result, the prison illegal practices assumed a face of legality and created new forms of rationalities within the camp of crime control and repression, adapted to the reality of punitive policies worldwide since the 1990s.
