Brazilian public transparency: development of accountability and implementation the Rule of Law

The Rule of Law, as a constitutional principle and foundation of postmodern constitutionalization process, emerges as a multifaceted concept that demands effectiveness in societies. This article intends to expose the importance of accountability as a mechanism for effecting the Rule of Law. For this, it interprets as presuppositions of this mechanism: public transparency, access to information and social control, from the theoretical contributions of Guillermo O’Donnell, Andreas Schedler, Staffan I. Lindberg, Francis Fukuyama and Martin Krygier. The author’s contributions also serves as a reference for analyzing the empirical data from the Transparency Index Reports and the first National Conference on Transparency and Social Control and from the first year of the Law on Access to Information.Downloads
