This article aims to discuss the role of the Public Defender’s Office of the State of São Paulo (DPESP) in urban land conflicts, through the question of the institution’s role in fulfilling the social right to housing. In order to do so, the article focuses on the public defenders’ discourses, through their interviews. The work’s theoretical framework is the judicialization of social policies, detailing the dilemmas and limitations of judicialization in the field of right to housing. It concludes that the role of the Public Defender is to affirm the right to housing as a social right that should be enforced by the State, through the assertion of the intrinsic relationship between this right and the fulfillment of the social function of property.
