Gender (un)equality in the lisbon and braga family courts: the study of judicial sentences of parental responsabilities regulation in Portugal

In Portugal, the mutations in the regulation of family relations, and specifically in the case of parental responsibilities, followed the European tendency and responded to the necessity of promoting equality and women’s rights, the growth of divorced or separated parents and to the new families’ configuration. In this article we aim to discuss the evolution of the regulation of parental responsibilities in Portugal from 1974 to the present, in what concerns the fulfilment of the equality principles. In order to discuss if and how these changes impact the judicial practice, we will present a quantitative and qualitative analysis of a collected sample of family resolved cases in 2010, in two Family Courts, Braga and Lisbon, and of interviews with legal professionals.Downloads
