A ação antipaternalista do Comitê Olímpico Internacional na criação dos atletas independentes olímpicos

According to John Stuart Mill, the paternalistic action is only necessary and so only legitimate when individual competencies provide or cause harm to others or themselves. In such conditions, the States, societies, laws, etc. interventions are necessary. However, paternalism is used as a form of social and individual progress in society by means of modern concepts of nationality. When it comes to the Olympic Games, the national representations required, granted by the International Olympic Committee, are one such paternalistic actions that escapes the Mill legitimacy. In that way, when creating the delegation of athletes without a national representation at the Olympics Games, the Independent Olympic Athletes, the IOC awards and overrule individual freedom, individuality and free will of the athletes considered first as individuals and not representative of a national collectivity. Therefore, the creation of such exclusive and rare delegation evidences an antipaternalistic action.
