Abstract

The institutionalization of political protection of historical heritage in Brazil was associated with an ideal of identity. The creation of SPHAN in 1937 was marked by the values of the modernist intelligentsia. The focus has been the material representations, particularly architectural. São Paulo State creates the CONDEPHAAT three decades later and the municipalities are mobilizing on the issue only from the 80's. The concept of heritage, however, has become. Replaces the term "historical and architectural" by "cultural", but extends to intangible manifestations. The protection is not based upon the persecution of symbols of national identity, but the memory of society. The mention of cultural rights, the rights of citizenship, has to be defined broadly the purpose of protection of cultural.
