Abstract

Few institutions have undergone such profound changes as the Brazilian family. The changes affect both the institution of marriage and the relations of power and responsibility between mothers and fathers. Recent data confirms that family size has decreased as well as divorce and consensual unions have increased over time. It is necessary to highlight that changes in family laws have followed changes in real life as shown in the 1982 Constitution and the 1990 Statute of Children and Adolescents. Thus, the consolidation of new legal rights is accompanied by the increasing judicialization of social relations. In other words, the judiciary has become the arbiter of relations between parents and children, bolstering decisions in the field of human sciences. This paper presents some considerations on the implications of the judicialization of family relationships.

Maria Lygia Quartim de Moraes, UNICAMP – Universidade Estadual de Campinas. Instituto de Filosofia e Ciências Humanas – Departamento de Sociologia. Campinas – SP – Brasil

Maria Lygia Quartim de Moraes. Socióloga, formada em Ciências Sociais pela USP (1963-66), com cursos de pós-graduação na França e no Chile (1970-74). Doutorou-se em Ciência Política pela USP (1982) , defendeu sua livre-docência na UNICAMP (1997) e tornou-se professora titular da UNICAMP em 2004. Especialista em sociologia clássica é também pesquisadora das áreas de estudos sobre movimentos sociais, família e gênero, direitos humanos e memória política no perído 1964-82. Publicou livros, capítulos de livros e artigos no país e no exterior. Atualmente, é professora na Pós-Graduação em Sociologia da UNICAMP e pesquisadora do Pagu - Núcleo de Estudo de Gênero da UNICAMP.
