Abstract

The present article situates the torture discussion in contemporary days referencing different analysis possibilities: State of Law’s limited readings, which at the present time understand this practice as a violation of fundamental modern acquisitions; threatened at present. Yet, a different reading that transcend the previous perspective when disclose a different politic-judicial structure, which is properly working in modern societies.
