Political science education: Codification of legislation in various legal systems

Resumo

O ensino da ciência política concentra-se principalmente em cinco áreas principais: o funcionamento do governo, as políticas públicas, a teoria política, o comportamento político e as relações internacionais. Este artigo apresenta um estudo educacional de análise comparativa da codificação da legislação em vários ordenamentos jurídicos. Os autores analisam as características da sistematização da legislação nos países dos sistemas jurídicos romano-germânico e anglo-saxão. Com base nos resultados, concluiu-se que é a tradição jurídica continental a mais propícia à atividade de codificação. O baixo volume de normas legais estatutárias no sistema jurídico anglo-saxão impede a codificação, mas fornece flexibilidade regulatória adequada. Ao mesmo tempo, recentemente, em países de direito consuetudinário, tem havido uma tendência de aumentar a participação da lei estatutária na regulamentação das relações públicas. Nesse sentido, aumenta a importância do trabalho de codificação na sistematização da legislação.
